Terms & Conditions

1. Customer Information

The customer agrees to provide accurate, complete, and up-to-date information while submitting any form or registering on the Sampatti Bajaar platform. Sampatti Bajaar reserves the right to verify, modify, suspend, or reject information that appears incorrect, misleading, incomplete, or fraudulent.

2. Subscription & Service Charges

Any subscription, registration, listing, promotion, advertising, or other service charges must be paid according to the applicable plan selected by the customer. The customer is responsible for reviewing the selected plan, duration, features, and applicable charges before making payment.

3. Non-Refundable Subscription Payment

All subscription fees and service charges paid to Sampatti Bajaar are NON-REFUNDABLE and NON-TRANSFERABLE, once the payment has been successfully processed. This applies regardless of:

• Change of mind by the customer
• Failure to use the service
• Failure to receive expected leads or business results
• Change in property requirements
• Expiry or cancellation of the subscription
• Customer's failure to provide required information/documents
• Temporary unavailability of any particular feature

By making payment, the customer expressly acknowledges and accepts this Non-Refundable Payment Policy.

4. Subscription Cancellation

The customer may request cancellation of their subscription; however, cancellation does not automatically create a right to a refund. Any remaining subscription period may continue until its scheduled expiry, subject to the applicable plan and Sampatti Bajaar's policies.

5. No Guarantee of Leads or Sales

Sampatti Bajaar may provide property listings, marketing, lead-generation, promotional, or related services. However, Sampatti Bajaar does not guarantee any specific number of leads, site visits, sales, rentals, bookings, or financial returns unless expressly agreed in writing. Business results may depend on market conditions, property pricing, location, demand, customer response, and other factors beyond Sampatti Bajaar's control.

6. Property Information

Property owners, brokers, agents, and customers are responsible for the accuracy of the property information submitted by them. Sampatti Bajaar does not guarantee the accuracy, legality, ownership, title, approvals, dimensions, pricing, or other claims made by a property owner, broker, agent, or third party. Customers are advised to independently verify property documents and legal status before making any financial commitment or transaction.

7. Third-Party Transactions

Sampatti Bajaar may facilitate communication between customers, property owners, brokers, agents, and other parties. Any transaction, agreement, payment, booking, sale, purchase, lease, or other arrangement between users is undertaken at the parties' own responsibility.

8. Brokerage / Commission Charges

If a property sale or purchase is successfully completed through, with, or by the assistance of Sampatti Bajaar, a brokerage/commission of 2% of the final transaction value shall be payable by the buyer and 2% of the final transaction value shall be payable by the seller to Sampatti Bajaar. The commission shall be calculated on the final agreed property transaction value and shall become due as per the transaction/closure terms agreed with Sampatti Bajaar.

If a property is successfully rented/leased through, with, or by the assistance of Sampatti Bajaar, the buyer/tenant and the seller/landlord shall each pay one month's rent as commission to Sampatti Bajaar. This commission is payable separately by each party and is due upon successful completion of the rental/lease transaction.

The parties acknowledge and agree that these brokerage/commission charges are separate from any subscription, listing, advertising, promotion, or other service charges, unless otherwise agreed in writing by Sampatti Bajaar.

9. Prohibited Activities

The following activities are strictly prohibited:

• Providing false or misleading information
• Fraudulent property listings
• Unauthorized advertisements
• Spam or abusive communication
• Illegal activities
• Impersonation of another person or organization
• Any activity that may damage Sampatti Bajaar or its users

Sampatti Bajaar reserves the right to suspend or terminate accounts involved in such activities.

10. Service Modification

Sampatti Bajaar reserves the right to modify, update, suspend, discontinue, or introduce features, plans, prices, or services at any time. Changes may be made without prior notice where reasonably necessary.

11. Account Suspension or Termination

Sampatti Bajaar may suspend or terminate a customer's account or service if the customer violates these Terms & Conditions, provides false information, engages in fraudulent activity, or misuses the platform. Termination due to a customer's violation does not create an automatic right to a refund.

12. Intellectual Property

All logos, branding, website content, designs, graphics, videos, text, software, and other materials belonging to Sampatti Bajaar are protected by applicable intellectual-property laws. Customers may not copy, reproduce, modify, distribute, or commercially use Sampatti Bajaar's content without prior written permission.

13. Limitation of Liability

Sampatti Bajaar will not be responsible for indirect, incidental, consequential, or business losses arising from the use of the platform or services, including loss of business opportunities, expected profits, or transactions. Sampatti Bajaar's role is limited to the services specifically offered under the applicable plan.

14. Customer Consent

By submitting, the customer confirms that:

• The information provided is accurate.
• The customer has read and understood these Terms & Conditions.
• The customer agrees to the applicable subscription/service charges.
• The customer understands that subscription payments are non-refundable.
• The customer agrees to Sampatti Bajaar's service policies.
• The customer authorizes Sampatti Bajaar to contact them regarding their enquiry, subscription, property requirements, and related services.

15. Changes to Terms

Sampatti Bajaar reserves the right to update these Terms & Conditions from time to time. The latest version published on the website will apply to future use of the services.

16. Protection of Company Reputation & Non-Disparagement

The customer, user, or any associated party agrees not to engage in any activity, whether online (including social media, public forums, and review platforms) or offline, that maliciously defames, disparages, or unlawfully damages the reputation and goodwill of Sampatti Bajaar. In the event that any individual or entity is found to be intentionally publishing false claims, orchestrating smear campaigns, or undertaking actions to destroy or take down the company's brand image, Sampatti Bajaar reserves the absolute right to initiate immediate legal action. This includes, but is not limited to, pursuing civil and/or criminal proceedings in the applicable jurisdiction (e.g., Agra, Uttar Pradesh) against the offending person or entity to seek financial damages, compensation, and injunctive relief.

17. Acceptance

By clicking "Submit", "Register", "Subscribe", "Pay Now", or any similar button, the customer confirms that they have read, understood, and agreed to these Terms & Conditions, including the Non-Refundable Subscription Policy, the applicable Brokerage / Commission Charges, and the Protection of Company Reputation clause stated above.
